XLII., R. 21, is as follows:--The production of a writ of execution, or of the notice renewing the same, purporting to be marked with such seal as in the last preceding rale mentioned, showing the same to have been renewed, shall be sufficient evidence of its having been so renewed. Questions of nicety often used to crop up in the High Court respecting the service of proceedings therein, and the mode of proving such service. The Rules of 1883 attempt to grapple with this evil, but it remains to be discovered by actual practice whether or not they have much simplified matters. The most important Rules on this subject are as follows:--First, Order LXIV., R. 11. Service of pleadings, notices, summonses, orders, rules, and other proceedings, shall be effected before the hour of six in the afternoon, except on Saturdays, when it shall be effected before the hour of two in the afternoon. Service effected after six in the afternoon on any week-day except Saturday, shall, for the purpose of computing any period of time subsequent to such service, be deemed to have been affected on the following day. Service effected after two in the afternoon on Saturday shall, for the like purpose, be deemed to have been effected on the following Monday. R. 12. In any case in which any particular number of days, not expressed to be clear days, is prescribed by these Rules, the same shall be reckoned exclusively of the first day and inclusively of the last day.
